1. Provider and Scope

These Terms of Service apply to the use of the website and, once available, the Joya app.

The service provider is:

Joya Social is a sole proprietorship. There is no entry in the commercial register.

These Terms apply to all persons who visit our website, register for Joya, create a user account, use the Joya app, send a VYB request, participate in a VYB, or contact Joya.

2. Note on App Launch

The Joya app is currently in preparation. The website can already be used before the app launches, in particular to learn about Joya, sign up for updates, or get in touch.

App-related features, including user accounts, onboarding, VYB requests, matching, chats, push notifications, and participation in VYBs, will only be available once the app has been released and you use these features.

3. About Joya

Joya is a service for real-world social experiences. Joya's goal is to bring people together into small, compatible groups based on availability, location, social intention, and personality signals.

A VYB is a real-world meetup with typically 3 to 6 people. Joya can match users based on various inputs, including availability, location, age, gender, social intention, and personality signals.

Joya is not a dating app, not a follower-based social network, and not an event organiser. Joya provides a technical platform to facilitate real-world social encounters.

4. Registration and User Account

Certain features of the Joya app require a user account. You can register with Apple, Google, or email and password.

You are required to provide accurate and up-to-date information when registering and using Joya. You may not create an account on behalf of another person or share your account with third parties.

You are responsible for keeping your login credentials confidential and for notifying Joya immediately if you suspect unauthorised use of your account.

5. Minimum Age

Joya may only be used by persons who are at least 18 years old.

By registering or using the app, you confirm that you are at least 18 years old. Joya may suspend or delete user accounts where there is doubt about the minimum age or where false information has been provided.

6. Onboarding and User Information

To create well-matched VYBs, the app asks for certain information during onboarding. This may include age, gender, social intentions, and personality signals.

This information helps Joya to form groups based not only on time and location, but also on social compatibility.

You are responsible for providing your information honestly and appropriately. Joya cannot create meaningful suggestions if information is deliberately false, misleading, or provided in bad faith.

7. VYBs and Matching

A VYB is a real-world meetup with typically 3 to 6 people. Joya uses available data to suggest or create compatible groups, time slots, and meeting points.

Matching may be automated. Joya aims to bring together compatible groups but does not guarantee that every VYB will meet your expectations or that a VYB will actually take place.

You decide whether to request, accept, or join a VYB. Participation in real-world meetups is at your own responsibility.

8. Meeting Points and Locations

Joya may suggest meeting points, venues, or areas for VYBs. These suggestions are intended for orientation and organisation purposes.

Joya does not operate the suggested locations and is not responsible for opening hours, availability, prices, quality, safety, or the behaviour of third parties at these locations.

You are responsible for being aware of your surroundings and for deciding independently whether to attend, stay at, or leave a meetup.

9. User Conduct

Joya depends on people treating each other with respect, honesty, and responsibility.

You agree in particular:

to treat other users with respect

not to engage in harassing, discriminatory, threatening, or abusive behaviour

not to use false identities

not to share content that is unlawful, offensive, sexually harassing, discriminatory, glorifying violence, or otherwise inappropriate

to respect the boundaries of others

not to deceive, pressure, or coerce other users

not to use Joya for advertising, spam, fraud, or unsolicited commercial outreach

to behave appropriately and responsibly at real-world meetups

Joya may publish Community Guidelines. Once available, these will apply in addition to these Terms as binding rules of conduct.

10. Safety, Reports, and Blocking

Joya provides features that allow users to report or block other users.

If you feel unsafe, are treated inappropriately, or notice a rule violation, you can report this through the in-app features or by email to hello@joya.social.

Joya may review reports and take action, including issuing warnings, removing content, restricting features, temporarily suspending, or permanently deleting user accounts.

In cases of immediate danger or emergency, please contact the local authorities or emergency services. Joya does not replace police, emergency services, or other public authorities.

11. Communication and Content

Joya may provide group chats, messages with friends, messages with Eva, or other communication features.

You are responsible for the content you send or publish through Joya. You may not share content to which you do not hold the rights or that violates third-party rights, applicable law, or these Terms.

Joya is not obligated to review all content in advance. Joya may remove or restrict content that violates these Terms, Community Guidelines, or applicable law.

12. Availability and Changes to the Service

Joya aims to operate the website and app reliably. However, uninterrupted availability is not guaranteed.

Joya may modify, expand, restrict, temporarily suspend, or discontinue features where required for technical, commercial, legal, or safety reasons.

During the preparation, testing, and launch phase, features may be limited, imperfect, or only available in certain cities, groups, or for certain users.

13. Pricing

Use of Joya is free of charge at the time of these Terms.

Joya may introduce paid features in the future. In that case, we will clearly inform you in advance about prices, scope, and payment terms. Paid features will only arise if you explicitly select or book them.

14. Suspension and Termination

You may delete your user account or stop using Joya at any time.

Joya may temporarily suspend or permanently delete your user account if you violate these Terms, Community Guidelines, or applicable law, provide false information, endanger other users, or misuse the platform.

Joya may also suspend or delete accounts where this is necessary to protect other users, prevent misuse, maintain service security, or for legal reasons.

15. Account Deletion

You can delete your Joya account directly in the app. Joya also provides a way to request account deletion through the website.

16. Privacy

For information about what personal data Joya processes, for what purposes, on what legal basis, and what rights you have, please see our Privacy Policy.

17. Liability

Joya is fully liable for intent and gross negligence, as well as for injury to life, body, or health.

In cases of simple negligence, Joya is only liable for breaches of material contractual obligations. Material contractual obligations are those whose fulfilment makes proper use of the service possible in the first place and on whose compliance users may regularly rely. In such cases, liability is limited to the foreseeable, typically occurring damage.

Joya is not liable for the conduct of other users, for a VYB taking place or not, for personal expectations regarding a meetup, or for circumstances at third-party locations, to the extent that Joya is not responsible for these.

Participation in real-world meetups is at your own responsibility.

18. Intellectual Property

All rights to the website, the app, the Joya name, designs, texts, features, software, logos, and other content remain with Joya or the respective rights holders.

You are granted only the right to use Joya within the scope of these Terms and its intended features. Reproduction, modification, distribution, or commercial use of Joya content is only permitted with prior consent, unless permitted by law.

19. Changes to These Terms

Joya may update these Terms where required due to legal, technical, commercial, or functional developments.

We will inform you of material changes in an appropriate manner. If you continue to use Joya after updated Terms take effect, the updated Terms will apply, to the extent permitted by law.

20. General Provisions

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer habitually resident in the European Union, mandatory consumer protection provisions of your country of residence remain unaffected.

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
